Securitization

In 2002, Taiwan enacted the Financial Asset Securitization Act, followed by the Real Estate Securitization Act in 2003. Lawyers play a critical role in securitization cases, assisting government agencies and businesses in establishing effective and commercially viable legal frameworks. Since securitized products entered the market, LCS has actively collaborated with clients to develop innovative securitization products and legal services, maintaining a leading position in Taiwan's securitization market.

LCS has participated in numerous major asset securitization projects in Taiwan, successfully representing arrangers and other participants. These include various financial asset securitization cases (using corporate loans, accounts receivable, structured bonds, and collateralized debt obligations (CDOs) as underlying assets), real estate asset trust cases, and real estate investment trust cases (LCS handled the first real estate securitization case in Taiwan). We also provide ongoing legal consultation for post-issuance management, dispute resolution, and liquidation upon termination. LCS serves as the primary legal advisor for five of Taiwan's nine real estate asset trust (REAT) transactions and has extended its leading position in real estate asset trust securitization to real estate investment trust (REIT) securitization, acting as the primary legal advisor for multiple REIT cases in Taiwan. Furthermore, LCS lawyers were recognized as leading lawyers in Asian securitization for three consecutive years (2006, 2007, and 2008) by Asia Law.
